1. Data protection

The protection and safety of personal data has highest priority at ARCA-Consult GmbH (in the following ARCA-Consult). Hence, ARCA-Consult, its employees and contractors comply with the rules of the European General Data Protection Regulation (GDPR) and the corresponding reference works.

Personal data are treated as confidential in accordance with the data protection provisions as well as data protection statements. ARCA-Consult GmbH takes any technical and organizational protective measures to ensure the security of provided personal data and to exclude unauthorized third party access.

The use of this website of ARCA-Consult is usually possible without providing any personal data. User data (e.g. name, postal and email address) are collected always on a voluntary basis, whenever possible or in connection with preparing the conclusion of a contract, e.g. at the time of registration for training sessions. In this cases the consent to collect and process the data shall explicitly be obtained by the data holder. 

Thus without the explicit consent data shall not be transferred to third parties in general. The explicit consent shall be obtained in each individual case, e.g. if the final examination of a training session, the user has registered for, is performed by an external test institute. 

ARCA-Consult points out that transferring data in the internet (e.g. communication via email) may involve security gaps. Hence, a gapless data security in order to protect from third party access is not possible.

ARCA-Consult objects expressly the use of the contact data, published within the framework of the imprint, for sending of not explicitly requested advertising and information material. ARCA-Consult expressly reserves the right to take legal action in the event of unsolicited sending of promotional information, such as through spam mails. 

 

2. Right of access, rectification, deletion and objection, data portability and complaints

Right of rectification and deletion

Referred to article 16,17 of European GDPR the visitors and users of this website are free at all times to consult their data and to have them rectified or deleted, if there is no contradiction of legal or contractual regulations. An informal notification sent to the email or postal address shown below is sufficient.

ARCA-Consult will immediately act according to the user’s or visitor’s request, but points out that in some cases (e.g. sending of newsletter) it is not always possible to stop various actions that had already been taken. Hence, it may occur that the user will receive letter post or emails from ARCA-Consult for a short period after the revocation. 

 

Right of access

3. Data protection declaration for the participation in training sessions

ARCA-Consult collaborates with service providers that perform a test after the training session in order to determine the qualifications and competences. Hence, ARCA-Consult collects and processes personal data, which may be transmitted to external third parties for the test performance. The third parties undertake necessary duties for the examination process, in particular the correction of the test and the issuance of the certificates. 

The required data are the following:

First and last name, address, date of birth, place of birth, country of birth, email address, certification-ID, date of issue and if necessary the test result of previous tests. 

When signing up for a training session or registering for a test at ARCA-Consult or at an external training organization, the participant declares his or her consent to the collection, process, transfer and use of personal data within the framework of the participation of the training or test by ARCA-Consult, as long as ARCA-Consult and the assigned external service providers comply with the respective data protection regulations.

 

4. Data protection declaration for the use of Google Analytics

This website uses functions of the website analysis service Google Analytics. The provider is the following: Google Inc., 1600 Amphitheatre Parkway Mountain View, CA 94043, USA.

Google Analytics uses cookies, text files that are saved to the user’s computer, which allow to perform analysis of website use. The information generated by cookies on the usage of this website will be transmitted to a server of Google in the USA and will be stored accordingly.

In case of activating the IP-anonymity on this website, the IP-address of the visitor will previously be shortened within the Member States of the European Union or in another treaty state of the Agreement on the European Economic Area by Google.

5. Data protection declaration for the usage of XING

The website of ARCA-Consult uses functions of the social network XING. The provider is XING AG, Dammtorstraße 29-32, 20354 Hamburg, Germany. In each proclamation of a page of this website of ARCA-Consult, that incorporates some functions of XING, a connection to the server of XING will be made. According to ARCA-Consult’s knowledge, personal data are not stored in that respect. In particular IP-addresses are not saved and usage patterns are not evaluated or recorded.

6. Cookies
